1. Business Identification

Under UK law, you must clearly identify who the customer is contracting with.

2. Contract Formation

Clearly state that a legally binding contract is only formed when you dispatch the goods, not when the customer places the order. This allows you to cancel orders if there is a pricing error or stock issue.

3. Pricing and Payment

  • Pricing: Prices include [VAT/Taxes] but exclude [Delivery Costs], which are calculated at checkout.

  • Errors: We reserve the right to correct any pricing errors, even after an order has been placed, though we will notify you before dispatch.

4. Delivery Rights

  • Standard Delivery: We aim to deliver within 14 days. By law, if no time is specified, goods must be delivered within 30 days.

  • Risk: You become responsible for the goods from the time we deliver them to you or your nominated person.

5. Right to Cancel ("Cooling-off Period")

For most online purchases, UK consumers have a 14-day statutory right to change their mind.

  • Cancellation Window: Customers have 14 days from receiving the goods to notify us of a cancellation, and a further 14 days to return the items.

  • Exclusions: This right does not apply to personalised items, perishable goods (e.g., food), or sealed hygiene items once unsealed.

  • Refunds: We will refund the full price and standard delivery costs within 14 days of receiving the items back.

6. Faulty Goods (SAD FART Rules)

Under the Consumer Rights Act 2015, goods must be of Satisfactory quality, As described, and Fit for purpose.

  • Within 30 Days: If the product is faulty, you are entitled to a full refund.

  • Within 6 Months: If a fault develops, we will first attempt to repair or replace the item.

7. Limitation of Liability

Specify that you are not liable for business losses (e.g., loss of profit) if you only sell to consumers. Note that under UK law, you cannot limit liability for death or personal injury caused by your negligence.

8. Governing Law

"These terms are governed by the laws of England and Wales (or Scotland/Northern Ireland), and any disputes will be settled in the courts of that jurisdiction".
